    Aziz Bari says Article 153 shortchanges no one

    KUALA LUMPUR, Dec 26 — Constitutional expert Abdul Aziz Bari said Article 153 of the Federal Constitution protects all communities and not just Bumiputeras, saying Perkasa is wrong to claim it is only for the dominant majority.

    Perkasa had warned Christians yesterday not to question the provision the Malay rights group says is to protect the rights of Bumiputeras.

    The International Islamic University (UIA) law professor told The Malaysian Insider “the constitution is clear that no one should be shortchanged.”

    “The wording of Article 153(1), that actually sets the tone and theme of the provision, seeks to be fair to all — the backward Malay and Borneo native communities as well as all other communities,” he said in an email sent to The Malaysian Insider.

    On Saturday, National Evangelical Christian Fellowship (NECF) chairman Reverend Dr Eu Hong Seng said Article 153 is akin to “bullying” if it only protects the rights of one group.

    But Perkasa responded by saying the Article helped keep the country peaceful, further claiming that the race riots of May 13, 1969 happened because it was not implemented properly.

    “This country is peaceful because of Article 153 which protects the rights of Bumiputeras who are the majority in this country.

    “The reverend needs to remember that Christians are able to practise their religion without worry in this country because of Article 153,” Perkasa secretary-general Syed Hasan Syed Ali said.

    Article 153 states that “it shall be the responsibility of the Yang di-Pertuan Agong to safeguard the special position of the Malays and natives of any of the States of Sabah and Sarawak and the legitimate interests of other communities in accordance with the provisions of this Article.”

    Aziz said this meant “the King must also make sure that (safeguarding Bumiputeras) must not be done at the expense of the legitimate interests of other communities.”

    “It is not quite right for Perkasa to issue that challenge and bring back the May 13, 1969 issue. The priest never questioned the basis or continuance of Article 153, he merely expressed an opinion on the manner it has been practised.

    “This is perfectly acceptable, nothing seditious about it,”

    The provision in the Federal Constitution has been repeatedly invoked by Malay right-wing groups who insist on the continuance of pro-Bumiputera affirmative action.

    These include quotas in education, scholarships, business equity and employment in the public sector.

    Aziz was recently embroiled in controversy after stating the Selangor Sultan’s intervention in a raid on a church by state religious authorities was “unusual and inconsistent” with Islamic teachings.

    Sultan Sharafuddin Idris Shah had decreed that the Selangor Islamic Religious Department (Jais) had found evidence of proselytisation by non-Muslims during a dinner held at the Damansara Utama Methodist Church (DUMC) on August 3 but said there was insufficient for further legal action.

    Aziz is being investigated by the International Islamic University (UIA) and police over his remarks but has since announced that he will quit the varsity at the end of the year.

      Do we need to bring it to the International court for the interpretation of the Article 153? That's what Perkasa want isn't it/ They thought that they are always right and dare to challenge or even warn other communities. What type of organisation is this who wanted to bring Malaysia into chaos?

      The issue is not about the article 153(1), it about those on the pretext of upholding exploit it to their advantage to gain and protect their positions. It is about personal interest vs public interest. We need politicians who are above board and we are lucky we have quite a handful in our country. If only we can get them to work as a team irrespective of race but as Malaysian, we can conquer and come out champions in many if not most of fields.

      Now is the awaking era. Malaysians are Malaysians. Everyone needs and has to respected. This has to be earned and not demanded/coerced. If one tells fellow Malaysian to leave the country, who is the former? Many, many so call Bumiputras, when did earn the status Bumiputra? This is best left unraised.

      Personally, present PM Najib is all to be praised. He though a PM is limited/restricted by his supporters and "cronies". He is the 2nd generation prime minister who was since childhood has saw/heard the many power tradings, knows what power is. He is well positioned and competent to take the bull by the horn but unfortunately time is against thim. He is trying to knock down the malay mentality wall that they have the inherited right/privileges. It is easy to earn popularity by establishing an institution of handouts and the successor wishing to retain his popularity may resort to bigger handouts but when will this end. Europe is a fine example when the party is over, who is footing the bills?

      To bluntly put it, the people who jealously defend the S153(1) are the people who want to divide and rule for their own benefit. These people are the old veterans wanting to cling on to power with the same slogan "we are championing the malays' right" with present many educated malay will interprete "let us alone". We have many capable malays who want the nation to march on will have this to say "you old useless greedy stumbling block please move out of our way or we will throw you out".

      For many it is not a question who forms the government. It can be the liberal, conversative, republican, communist or your son, the question is who has our interest at heart.

      To all politicians we elect to serve us well. We are here to serve you. We honour and bow before you if you do your job with all your heart. Thanking you in anticipation for our childreen and grand children

      If we can accept and respect Article 153 and the PERLAMBAGAAN and not questioning it and continue provoking on and off, all will be all right as the article protect all stakeholders.Do not get greed into our mind. Situation in China and Singapore are different from us.They are Chinese dominated and Malaysia is Malay dominated and those Malays are still behind in general .Look at statistics as a total.Meritocracy as practice in Singapore does not work here until the level playing field is achieved.We are moving in the right direction though.There is a lot more to be done for the poor RAKYAT regardless of which kaum and I think we are in the right tracks given all the the social,economic and political transformations now.Malaysia shall continue progressing whoever rule.If it is for the RAKYAT and UNITY I will go for it.The words like morons and the likes should never exist in our vocabulary.It will only reflect on the writer .It will only create anger and promote hatred when we can be better Malaysians and be more civilised.I for once will NEVER use it.

      Aziz make the right decision to leave UIA and move on to other platforms academic and/or political in the best interest of all parties.People come and go UIA remains.He may contribute positively as an independent individual hopefully and I believe he will for issues he strongly feels.That is the beauty in democratic Malaysia.Agree ?         Malays are only 50 percent of entire total population , haven't you heard ? Add in another 10 percent non malay muslims you get a total of 60 percent if you count them as malays too . That is only a simple majority. Practise of meritocracy will never be achievable if there was never a start of competition, unless those tongkat addicts will someday come to their sense and throw the tongkat away , start walking by themselves.       Aziz what you are saying is right, we need more people like you to voice up what is right on article 153 not by a bunch of moron who misleading and only want to enrich themselves not the rest of the Malay in this country under the pretext of safeguarding the right of the malay.

      If we need this country to properous and everyone become rich to become develop nation
      , we must get rid of this AI and rent seeker who is sucking dry the country resources.

      Look at other country example like Singapore and China, they also have minorities and their government job is to see the rakyat is educated become smart and fair to their policy in distributing scholarship to their rakyat. Their country need smart student to get in the university with fierst competition and not on racial quota, what they mean is they need quality not quantity of the graduate came out of the university which can help to push the nation more faster into develop the nation. The important thing is CORRUPTION is their enemy, even everybody is not above the LAW whether it is rakyat or politician.

UIA is correct and fair interpreting Article 153. Bumi status is guaranteed in the Fed Constitution since Merdeka to assist ALL backwards races to compete and share in the nation's progress. These "special Rights" slogan has been hanaging around the mouths of Malays w/o realizing it put many backwards except those "opportunists" who took advantages and have really prospered. It's time to change the slogan to 1M'sia, and I can bet the genration born after year 2000 will be better equipped, provided a pragmatic education policy is in place, to compete and they'll no more be paracides. These new breed of youths will be more educated and perhaps multi-linqual to meet with not only M'sia, but world challenges..

      The thing is that majority of Malays like Perkasa can't think and rationalize logically like you.
      They think 'Bumiputras' were meant exclusively for them. The real natives of this Nation are the Jakuns, Semaraks, Dayaks, Murus, Ibans, Kadazans, K-Dusuns....to name a few.
      They are the ones who are neglected and the Govt need to protect their traditional ways of life and at the same time ensure their standard of living are improved - provided with utilities like water, electricity, sanitation and housing without any conditions imposed. If we can't even do that and even encroached into their native lands, then Article 153 defeats it's purpose and meaning. Btw, Perkasa do not use May 13 to intimidate other races, it's outdated....you guys will learn a costly lesson this coming 13 General Election 'cos using Race and Religion issues will bring about your very downfall !

      No matter how and who's interpretation,think is best we look at the weakness first,it have being so many years since the special privileges accorded to one race. It only make the other races stronger and better...simply because the others work harder. Those having the special privileges always think and depend on the Govn....so by having this special rights will not help anything or bring Malaysia to greater heights as a country if the mentality and mind set is solely on the Govn...sad to see others was deprived especially in education.

      Top scorer can't even enter our local university simply bcos 90% goes to the one race,worse,some even fail or not qualify...so we have this brain drain problem simply bcos other country offer to take the top student. Where does this bring Malaysia into the future.

      Perkasa shud list down all the rights the malay are entitled to under Art. 153. This way, the non malays will know and respect them. As it is now, everytime a non malay brings up an issue, Perkasa will manipulate and twist it to become a malay's rights issue and claim that the malays are being threatened and that the non malays are questioning the Constitution.
