Ahli Parlimen Sepang (PAS) Hanipa Maidin menegaskan Akta Derhaka yang dicadangkan adalah tidak wajar kerana Malaysia mengamalkan konsep Raja Berperlembagaan, ia ekoran pertikaian titah Yang Di-Pertuan Agong Tuanku Abdul Halim Mu'adzam Shah yang didakwa disediakan oleh kerajaan Barisan Nasional (BN).

Gesaan supaya peruntukan undang-undang baru ke atas individu yang menderhaka dibangkitkan oleh dua ahli Parlimen BN iaitu Datuk Bung Mokhtar Radin dan Shamsul Anuar Nasarah memandangkan banyak rakyat Malaysia yang sudah berani menghina institusi Diraja.

"Malaysia mengamalkan Raja Berperlembagaan, bukannya Monarki Mutlak," bidas Hanipa terhadap cadangan oleh kedua-dua ahli Parlimen BN tersebut supaya satu Akta Derhaka dilaksanakan seperti di negara Thailand bertujuan untuk menghukum mereka yang meghina institusi Diraja dalam negara.

Bung juga mendakwa masyarakat Cina khususnya sudah berani menghina institusi Diraja sebaik berakhir pilihan raya umum lalu pada 5 Mei lalu.

"Saya bukan perkauman, tapi selepas pilihan raya empat kes orang Cina menghina Raja telah dilaporkan," kata Bung.

Shamsul pula menggesa agar kerajaan supaya memandang serius untuk mengambil langkah memperkenalkan akta tersebut sebelum ianya terlambat dan menghakis kuasa Raja di dalam negara.

Awal bulan lalu, Suruhanjaya Komunikasi dan Multimedia Malaysia (SKMM) telah menahan seorang suspek yang dipercayai menghina Yang di-Pertuan Agong di laman sosial Facebook dan agensi berkenaan mengesahkan wanita tersebut akan disiasat di bawah Seksyen 233 Akta Komunikasi dan Multimedia 1998, dan jika disabitkan kesalahan boleh didakwa dibawah Akta Hasutan 1948.

Semalam Ketua Pembangkang Datuk Seri Anwar Ibrahim tetap bertegas wujudnya penipuan dalam pilihan raya umum ke-13 lalu, sambil menyifatkan titah Tuanku bukan suatu arahan dan boleh dibahaskan dalam Dewan Rakyat.

Anwar berkata teks ucapan tersebut telah disediakan oleh kerajaan BN untuk dibaca oleh Tuanku dan dalam mana-mana amalan negara demokrasi ia boleh dibahaskan di Parlimen.

"Ucapan itu dicadangkan oleh kerajaan untuk dibacakan oleh Agong untuk dipertimbangkan sebagai suatu yang serius dalam Dewan.

"Maksudnya pidato Tuanku itu adalah untuk dibahaskan, prinsip negara demokrasi ialah asasnya pertimbangan untuk dibahaskan, ia bukan arahan supaya jangan langgar undang-undang," kata Anwar yang ditemui sejurus selesai Istiadat Perasmian Dewan Rakyat dan Dewan Negara Ke-13 di Parlimen pagi ini.

Bagaimanapun dalam sidang Dewan Rakyat hari ini, ahli-ahli Parlimen BN mempersoalkan kenyataan oleh Anwar dan pemimpin pembangkang lain dengan menganggapnya sebagai satu tindakan derhaka kerana mengingkari titah Tuanku.

Tuanku bertitah semalam supaya semua pihak menghormati keputusan pilihan raya umum ke-13 lalu.

Selepas pilihan raya 5 Mei lalu, Pakatan Rakyat (PR) enggan mengiktiraf keputusan tersebut dengan mendakwa  berlaku penipuan dan salah guna kuasa sepanjang tempoh berkempen, malahan turut mendesak pemimpin tertinggi Suruhanjaya Pilihan Raya (SPR) meletak jawatan. - 26 Jun, 2013.
