fitnah Anggota Parlimen Shah Alam Abdul Khalid Samad terhadap Datuk Hamidah

Osman berhubung penyiaran gambar beliau memakai jubah paderi yang didakwa

''superimpose'' dalam laman blog Ketua Penerangan Wanita Umno itu.

Pesuruhjaya Kehakiman Datuk Hashim Hamzah membuat keputusan itu selepas

mendapati Abdul Khalid gagal mengemukakan dokumen asal yang didakwa mengandungi

artikel berunsur fitnah terhadapnya.

Beliau memerintahkan Abdul Khalid, yang juga Pesuruhjaya III PAS Selangor,

membayar RM20,000 sebagai kos.

Abdul Khalid dan Hamidah, yang juga bekas Anggota Dewan Undangan Negeri

Sungai Rapat, Perak, tidak hadir pada prosiding hari ini.

Abdul Khalid diwakili peguam Mohamed Hanipa Maidin dan Azhana Mohd Khairudin

manakala Datuk Hafarizam Harun dan Nor Emelia Iszeham hadir bagi pihak bagi

Hamidah.

Abdul Khalid memfailkan saman terhadap Hamidah dua tahun lepas berhubung

penyiaran artikel dan gambar ''superimpose'' beliau di laman blog defendan

hamidahosman.blogspot.com pada Januari 2010.

MAHKAMAH-KHALID 2 SHAH ALAM

Penyataan tuntutan Abdul Khalid yang difail pada 23 Dis 2011 mendakwa gambar

itu menunjukkan beliau seolah-olah seperti seorang paderi Kristian dan seorang

yang murtad.

Dalam penghakiman setebal 23 muka surat, Hashim berkata plaintif mendakwa

artikel yang disiar defendan adalah berunsur memfitnah dirinya maka beliau perlu

mengemukakan dokumen asal berhubung dakwaan itu.

Bagaimanapun, Hashim berkata Abdul Khalid mengemukakan satu dokumen yang

tidak diambil dari laman sesawang asal.

"Saya menegaskan bahawa beban pembuktian berhubung fakta berkenaan terletak

pada plaintif yang ingin mahkamah memeprcayai kewujudannya. Dalam kes ini, saya

berpendapat kegagalan plaintif mengemukakan dokumen asal yang didakwa

mengandungi artikel berkenaan menjejaskan kes plaintif," katanya.

Beliau juga berkata gambar Abdul Khalid yang didakwa ''superimpose''

berpakaian seperti paderi sememangnya cenderung bagi menunjukkan bahawa plaintif

seorang yang murtad, penyokong tegar agama Kristian yang menentang Islam dan

tidak menghormati perasaan umat Islam di Malaysia.

MAHKAMAH-KHALID 3 (AKHIR) SHAH ALAM

Bagaimanapun, Hashim berkata secara keseluruhan, artikel yang disiar tidak

mengandungi kenyataan berunsur fitnah terhadap plaintif.

"Saya mendapati secara keseluruhan, artikel itu bertujuan menyatukan umat

Islam bagi menentang penggantian perkataan ''God'' dengan kalimah ''Allah'' dalam

Kitab Injil yang menjadi isu hangat suatu ketika dahulu. Tajuk artikel itu "Umat

Islam Perlu Bersatu" sudah cukup umum bagi menunjukkan usaha menyatukan umat

Islam berhubung isu ini.

"Penulis juga didapati menggaris beberapa kemungkinan jika perkara di atas

dibenarkan serta merujuk kepada plaintif dan PAS hanya berhubung sokongan

plaintif serta tindakan parti itu mendiamkan diri berhubung isu berkenaan.

"Tidak terdapat di mana-manapun dalam artikel berkenaan apa-apa yang boleh

membawa maksud bahawa plaintif seorang yang murtad atau cenderung menjatuhkan

reputasinya," katanya.

Hashim juga berkata jika gambar yang didakwa ''superimpose'' itu benar-benar

wujud, artikel berkenaan mungkin boleh dianggap memfitnah plaintif namun

ketiadaannya menyebabkan elemen pertama dalam dakwaan fitnah tidak dapat

dibuktikan.
