KOTA KINABALU, 23 Mei (Bernama) -- Suruhanjaya Siasatan Diraja (RCI) bagi

menyiasat pendatang tanpa izin di Sabah diberitahu jumlah permohonan sijil

kelahiran lewat oleh ibu bapa meningkat secara mendadak sejak tahun 2009.

Penolong Kanan Pendaftar Mahkamah Tinggi Kota Kinabalu Melissa Chia berkata

ini berikutan kesedaran ibu bapa bagi mendapatkan sijil kelahiran meskipun lewat

didaftarkan.

Chia, yang merupakan Majistret Litar di Tawau dan Lahad Datu pada 2008,

berkata beliau pernah menjalankan satu inkuiri di Mahkamah Majistret bagi

permohonan sijil kelahiran lewat, iaitu kelahiran yang didaftar selepas 42 hari.

Beliau juga memaklumkan pada 2008, Hakim Besar Sabah dan Sarawak mengarahkan

agar satu inkuiri diadakan sebagai tapisan bagi menghalang pendatang tanpa izin

memperoleh kewarganegaraan untuk anak mereka tanpa mengemukakan permohonan untuk

sijil kelahiran lewat.

"Pemohon perlu membayar RM4 untuk pendaftaran. Mahkamah akan menetapkan

tarikh untuk siasatan bagi mendengar keterangan ibu bapa atau saksi lain,"

katanya ketika disoal pegawai pengendali Manoj Kurup.

Saksi ke-85 itu berkata biasanya, pada prosiding itu, beliau akan

mengesahkan tempat, masa dan tarikh bayi dilahirkan selain kad pengenalan ibu

bapa.

SURUHANJAYA-SIJIL LAHIR 2 KOTA KINABALU

Menjawab soalan peguam pemerhati Persatuan Undang-Undang Sabah Datuk John

Sikayun, Chia berkata dalam inkuiri itu, ada ibu bapa yang mengaku memperoleh

kad pengenalan menerusi ''Projek IC'' ketika bekerja di kem pembalakan atau estet.

Beliau berkata ibu bapa berkenaan memaklumkan mereka mendapat kad pengenalan

biru selepas didatangi sekumpulan individu yang meminta mereka mengisi satu

borang.

Perkara itu didedahkan kepada Chia selepas beliau meminta penjelasan mengapa

di ruangan sijil kelahiran anak mereka, kewarganegaraan ibu bapa dicatat sebagai

''tidak diketahui'' atau ''belum ditentukan''.

"Mereka berkata mereka bukan rakyat Malaysia namun berminat untuk menjadi

warganegara, jadi mereka diberikan IC," kata saksi itu sambil menambah semua

kenyataan ibu bapa berkenaan dicatat dalam nota prosiding inkuiri berkenaan.

Sementara itu, Pegawai Tadbir Pejabat Hal Ehwal Anak Negeri Sabah Norhayati

Abd Majid berkata sepanjang pengetahuannya, Mahkamah Anak Negeri tidak pernah

mengeluarkan sijil anak negeri kepada pendatang tanpa izin dan majoriti yang

menerimanya ialah kaum Cina.

"Suku kaum seperti Dusun dan Kadazan, mereka ini merupakan anak negeri oleh

itu mereka tidak perlu sijil ini," katanya sambil menambah keistimewaan status

anak negeri ialah boleh melabur dalam Amanah Saham Nasional, dan bagi bukan

Islam pula, mereka boleh menggunakan status itu untuk merujuk tuntutan berkaitan

waris.

Kepada soalan pegawai pengendali Jamil Aripin mengapa keterangannya sebelum

ini menamakan ''Jimmy Wong'' sebagai orang yang memperoleh sijil anak negeri,

Norhayati berkata itu hanyalah satu contoh.

"Satu Lembaga ditubuhkan berhubung sijil anak negeri ini, saya sebagai urus

setia mendapat tahu Yang Berhormat ini telah memohon sijil anak negeri, dan dia

mendapatnya secara teratur, tetapi dia tidak dapat buktikan dengan kukuh dia

adalah kaum Kadazan," katanya sambil beliau tidak tahu sama ada Mahkamah Anak

Negeri membatalkan sijil itu atau sebaliknya.

Beliau juga bersetuju dengan cadangan Jamil bahawa Mahkamah Anak Negeri

masih lagi menyelesaikan kes jenayah seperti rogol dan sumbang mahram melalui

bayaran ''Sogit'' meskipun kesalahan itu sepatutnya diadili mengikut Kanun

Keseksaan.
