KUALA LUMPUR, 6 Nov (Bernama) -- Kerajaan akan meneruskan pindaaan Seksyen

376 Kanun Keseksaan supaya mereka yang didapati bersalah merogol gadis di bawah

umur dan dijatuhi hukuman penjara mandatori tidak boleh merujuk seksyen lain

bagi meringankan hukuman.

Menteri di Jabatan Perdana Menteri Datuk Seri Mohamed Nazri Abdul Aziz

berkata pindaan membabitkan kesalahan merogol gadis di bawah umur itu adalah

untuk menghalang hakim daripada menggunakan Seksyen 294 Kanun Tatacara Jenayah.

"Pindaan yang dicadangkan itu bertujuan hakim tidak boleh mengguna pakai

Seksyen 294 Kanun Tatacara Jenayah (Akta 593) yang memberikan mahkamah kuasa

budi bicara dalam menjatuhkan hukuman," katanya kepada pemberita selepas bertemu

beberapa pertubuhan bukan kerajaan (NGO) yang mahu beliau mengkaji semula

pindaan Seksyen 376 Kanun Keseksaan di pejabatnya di bangunan Parlimen hari ini.

Turut hadir Presiden Majlis Peguam Lim Chee Wee dan aktivis wanita Maria

Chin Abdullah.

Pada sesi Dewan Rakyat 15 Okt lepas, Mohamed Nazri ketika menggulung

perbahasan Rang Undang-Undang Perbekalan 2013 peringkat dasar bagi Jabatan

Perdana Menteri berkata keputusan meminda seksyen itu dibuat berikutan jumlah

kes rogol melibatkan gadis bawah umur yang terlalu tinggi.

Selain itu, beliau berkata pindaan tersebut juga bagi memelihara golongan

gadis bawah umur daripada terdedah kepada jenayah rogol tanpa sebarang

perlindungan.

"Seksyen 376 Kanun Keseksaan adalah untuk melindungi gadis di bawah

umur... itu yang penting... kerana akhirnya, ibu bapa akan bertanya juga kepada

saya, sebagai seorang menteri yang mempunyai kapasiti untuk melindungi anak

mereka, itu sebabnya saya tiada bantahan dalam pindaaan Seksyen 376 Kanun

Keseksaan," katanya.

Mohamed Nazri berkata cadangan pindaan itu disokong Anggota Parlimen, Peguam

Negara serta badan bukan kerajaan (NGO).

Beliau berkata hukuman penjara mandatori akan terpakai dengan segera dalam

undang-undang kehakiman sejurus selepas pindaan itu diluluskan Dewan Rakyat.

Mengulas desakan Gabungan NGO untuk Kesaksamaan Gender (JAG) yang menentang

pindaan itu kerana dianggap tidak adil kepada pesalah rogol, Mohamed Nazri

berkata legislatif mempunyai kuasa menentukan bidang kuasa kehakiman.
